Terms of Service

By creating an account or using Sophisticated Savage (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service.

You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorized access. We may suspend or terminate accounts that violate these Terms.

You agree not to:

• Violate any applicable law or regulation.
• Infringe intellectual property, privacy, or other rights of others.
• Upload malware or attempt to disrupt the Service.
• Reverse engineer, scrape, or misuse the Service or its underlying models.
• Use the Service to generate harmful, harassing, deceptive, or illegal content.
• Resell, sublicense, or commercially exploit the Service without written consent.

You retain ownership of content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, process, and display your content solely to operate and improve the Service. We will not use your private content for advertising or sell it.

The Service may generate AI-assisted content. Outputs are provided "as is," may be inaccurate or biased, and do not constitute medical, legal, financial, or other professional advice. You are solely responsible for any actions you take based on AI output.

If the Service offers paid plans, fees are billed in advance and non-refundable except where required by law. You authorize us and our payment processors to charge your chosen payment method on a recurring basis until you cancel.

You may close your account at any time. We may suspend or terminate access for breach of these Terms, suspected fraud, or to comply with law. Sections that by their nature survive termination will continue in effect.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOPHISTICATED SAVAGE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU TO US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $100.

You agree to indemnify and hold harmless Sophisticated Savage from any claim arising out of your content, your use of the Service, or your violation of these Terms or any law.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute will be resolved by binding individual arbitration in Delaware under the Rules of the American Arbitration Association, except that either party may seek injunctive relief in court. You waive any right to a class action or jury trial. If you reside in the EU/UK, mandatory consumer protections in your jurisdiction still apply.

We may modify these Terms. Material changes will be notified by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
